Terms and Conditions

§ 1 Scope

These General Terms and Conditions (T&C) apply to all business relationships between Agro Group Guaira S.A. (hereinafter "Provider"), operating under the brand Immobilien Paraguay, and its clients. Deviating conditions of the client are not recognized unless the provider expressly agrees to their validity in writing.

§ 3 Scope of Services

The provider offers real estate brokerage services in Paraguay, including in particular:

  • Identification of purchasing opportunities for properties in Paraguay
  • Brokerage of purchase and sale contracts for real estate
  • Consulting on properties, locations, and legal framework in Paraguay
  • Support with the processing of real estate transactions

§ 4 Contract Formation

The presentation of properties on this website does not constitute a legally binding offer, but an invitation to make contact (invitatio ad offerendum). A contract for brokerage services is only concluded upon explicit written confirmation by the provider.

§ 5 Commission and Remuneration

The provider's remuneration is based on individually agreed terms. Unless otherwise agreed in writing:

  • The commission is due upon successful conclusion of a contract.
  • The amount of the commission is agreed in writing before the order is placed.
  • The commission is exclusive of applicable taxes under Paraguayan law.

§ 6 Client Obligations

The client agrees to:

  • Provide all information relevant to the brokerage completely and truthfully.
  • Immediately inform the provider if they conclude a purchase or rental contract elsewhere.
  • Keep the contact details of identified properties and sellers confidential.
  • Provide all necessary documents and powers of attorney in a timely manner.

§ 7 Limitation of Liability

The provider is only liable for damages resulting from intentional or grossly negligent conduct. Liability for slight negligence is excluded to the extent permitted by law.

All information about properties (areas, prices, locations, etc.) is based on information provided by the respective owners or third parties. The provider does not guarantee its accuracy and completeness. Legal or tax advice is not part of the brokerage service.

§ 8 Governing Law and Jurisdiction

The law of the Republic of Paraguay applies. The place of jurisdiction for all disputes arising from or in connection with these T&C is Asunción, Paraguay, provided the client is a merchant or a legal entity under public law. Consumer protection rights of the client remain unaffected.

§ 9 Data Protection

The processing of personal data is carried out in accordance with our Privacy Policy. → Privacy Policy

§ 10 Severability Clause

Should individual provisions of these T&C be or become invalid or unenforceable, the validity of the remaining provisions shall not be affected. The invalid provision shall be replaced by a valid regulation that comes as close as possible to the economic purpose of the invalid provision.
