What is the Escritura Pública?

The Escritura Pública (literally "public deed") is a notarially certified purchase contract prepared and authenticated by a Paraguayan Escribano Público (notary). Only after signing and registering the Escritura in the Registro de la Propiedad does legal ownership fully transfer to the buyer.

Why is the Escritura So Important?

Without a registered Escritura you only have a private law claim to the property but not full ownership – no absolute protection against third parties, no ability to mortgage the property, and risks in case of seller insolvency.

Documents Required

From the buyer: passport/Cédula, RUC number, marriage certificate if married. From the seller: original title deed, cadastral survey plan, municipal tax clearance, SET VAT certificate.
